You may, in these circumstances, have a right to claim for unfair dismissal.

If your injuries have occurred as a result of faulty or unsafe equipment or could have been prevented by wearing protective clothing you maybe able to bring a claim against your employer.

 

Road traffic accidents

Road traffic accidents are the most common accidents today, injuries can raise from minor whiplash to fatal injuries. Whether you were the driver, the passenger, pedestrian or cyclist or even if you were partly at fault we can advise you to your rights to compensation. 

If another driver was to blame. Their motor insurance will be obliged to pay for your claim.

Have you been a victim of a hit and run accident? You can still bring your claim because there is an organisation known as the Motor Insurance Bureau which pay compensation to for uninsured and untraced drivers. 

What you should do now is take photographs of your damaged vehicle or bike.

Take photographs of any visual injuries.

Take photographs or draw a sketch of the accident scene notify your insurers.

Seek medical assistance regarding your injury and keep a note of any expenses you incur as a direct result of your accident.

Trips and Slips

Broken or uneven paving, raised or sunken manholes, potholes, slippery surfaces or spillages on the floor may result in tripping or slipping accidents. Whether your accident has occurred on the street, in the supermarket, or at work, we can help.

To assist us, it will be essential for you to provide photographs of the hazard that caused your slip or trip with any relevant measurement. It maybe useful to place a ruler against the depth of the hazard. Any trip or hazard so you can illustrate the height or the depth of the hazard.

Victims of crime

Have you been assaulted? The criminal injury of compensation authority maybe able to pay you compensation if you have been a victim of crime including sexual offences.

It is imperative that you carry out the following immediately;

  • Report the offence to the police immediately.

  • Contact your GP

If you fail to do the above you claim maybe refused.

Please note that all claims must be made within 2 years of the incident.

Time limits for claiming

All legal proceedings should be started within 3 years of the date of the accident. This is known as the limitation period.

In rare circumstances the three-year deadline may start from the date of the injury was identified rather than the date the accident occurred for example you might attend the hospital with injuries of a fall where you have to return later when they identify a break. The deadline will then be measured from the date that you first became aware of you injuries.

For minors,(under the age of 18) the limitation period does not run until their 18th Birthday.

There are two limbs to your compensation, the first is an award for pain and suffering and the second is for any out of pocket expenses incurred as a direct result of the accident. The second in compensation for your injury, the amount depends on the seriousness of the injury and the length of time it takes you to recover. The award you will receive is calculated based on case law.
