Time limits for
claiming
All
legal proceedings should be started within 3 years of the date of
the accident. This is known as the limitation period.
In
rare circumstances the three-year deadline may start from the date
of the injury was identified rather than the date the accident
occurred for example you might attend the hospital with injuries of
a fall where you have to return later when they identify a break.
The deadline will then be measured from the date that you first
became aware of you injuries.
For
minors,(under the age of 18) the limitation period does not run
until their 18th Birthday.
There
are two limbs to your compensation, the first is an award for pain
and suffering and the second is for any out of pocket expenses
incurred as a direct result of the accident. The second in
compensation for your injury, the amount depends on the seriousness
of the injury and the length of time it takes you to recover. The
award you will receive is calculated based on case law.
